Terms of Trade
The conditions that apply to every export enquiry, quotation and order placed with Yuum Fresh Foods.
These are the rules that apply when you request a quote, ask for a sample, or place an order with Yuum Fresh Foods LLP. By contacting us for a trade enquiry, you agree to these terms.
1. Quotations & Pricing
Every quote we send shows the price, currency, what’s included, and how long it’s valid. Prices can change because commodity and freight markets move fast — an old quote is not a live offer.
2. Payment Terms
Payment terms are only final once written in your signed Proforma Invoice or Sales Contract. Anything shown on the website is just an example, not a payment instruction.
3. Shipping & Delivery (Incoterms)
We’ll agree an Incoterm — like FOB or CIF — based on your product, port and destination. This is confirmed in writing in your contract, along with who is responsible for what.
4. Quality & Inspection
Product quality is based on the specification and sample you approve. If you want an independent inspection, we can arrange one — just let us know in writing.
5. Force Majeure
We’re not responsible for delays caused by things outside our control, like export bans, port strikes, or natural disasters.
6. Dispute Resolution
Your signed contract will state how disputes are handled. If it doesn’t say, courts in Surat, Gujarat, India have jurisdiction. This website is not a substitute for a signed contract.
7. Contract Priority, Risk & Title
If anything on this website differs from your signed contract, the contract wins. Risk and ownership transfer as agreed in your Incoterm and contract.
8. Claims, Tolerances & Cancellations
Tolerances, inspection details, claim periods and cancellation terms are all written into your Sales Contract. Anything shown on the website — like calculators or sample rates — is only indicative, not binding.
9. Compliance
Both sides are responsible for following sanctions, customs, labelling and import rules for the destination country. We may pause or stop a deal if required approvals are missing.
